By using MOTOGRAPH, you confirm that you have read, understood, and agreed to these Terms and Conditions. These Terms apply to all users, including uploaders, contributors, and viewers.

2. Platform Purpose

MOTOGRAPH is a platform for sharing transit-related images. Users are solely responsible for the content they upload, ensuring it complies with these Terms and local laws.

3. Content Ownership and Licensing

Users retain ownership of the images they upload.

  • By uploading content, you grant MOTOGRAPH a non-exclusive, worldwide, royalty-free license to display and distribute your content on the platform.
  • This license will remain in effect until you remove the content from MOTOGRAPH. However, cached versions or backups may persist for a limited time.
  • MOTOGRAPH will not license, sell, or earn money from your photos without your explicit consent (e.g., via email or direct communication through the platform).
  • MOTOGRAPH reserves the right to remove any content that violates these Terms or is deemed inappropriate.

4. User Responsibilities

Users agree to:

  • Upload only relevant, transit-related images that are appropriate and meet quality standards.
  • Provide accurate tagging and metadata for all uploads.
  • Ensure captions are concise and non-offensive.
  • Be respectful in interactions, including comments and discussions.
  • Avoid uploading content that infringes copyright, violates privacy, or breaches local laws.

MOTOGRAPH may suspend or terminate accounts for:

  • Uploading inappropriate, irrelevant, or low-quality images.
  • Engaging in toxic behavior, including abusive comments or harassment.
  • Suspicious activities, including attempts to exploit or hack the platform.

Users may receive warnings before termination, but MOTOGRAPH is not obligated to provide prior notice.

5. Monetization and Donations

6. Liability

MOTOGRAPH is not liable for any actions taken by users on the platform or any connected services, such as Discord.

  • We do not offer insurance for lost or stolen content.
  • Users are encouraged to keep backups of their images.
  • MOTOGRAPH is not responsible for downtime, data loss, or technical failures, though we will make reasonable efforts to maintain platform stability.

7. Dispute Resolution

  • Governing Law: These Terms are governed by the laws of Australia.
  • Dispute Handling: Users agree to first attempt resolution through MOTOGRAPH’s support team.
  • Arbitration: If disputes cannot be resolved, they will be referred to binding arbitration under Australian arbitration laws.
  • Jurisdiction: Any legal proceedings must be filed in Australian courts.

8. Termination of Access

MOTOGRAPH reserves the right to suspend or terminate user accounts at its sole discretion for violations of these Terms or actions that harm the platform.

  • Users may or may not receive prior warnings before termination.
  • Users may request account deletion by contacting support.
  • Upon termination, user data will be handled per our Privacy Policy.

9. Amendments to Terms

MOTOGRAPH may update these Terms and Conditions at any time.

  • Users will be explicitly asked to accept the updated Terms before continuing to use the platform.
